The Loi d’orientation sociale n° 2010-15 du 6 juillet 2010 relative à la promotion et à la protection des droits des personnes handicapées (Social Framework Act No. 2010-15) provides for the promotion and protection of the rights of persons with disabilities. The provisions regarding reasonable accommodation set forth in the Convention are reflected in Social Framework Act No. 2010-15. It provides for various measures of protection, assistance and support and establishes that the treatment and care of persons with disabilities constitute a national obligation (art. 5). The ban on discrimination has been fully incorporated into Social Framework Act No. 2010-15 of 6 July 2010, which stipulates, in particular, that there must be no discrimination on the basis of disability in development projects and programmes run by the State or by partner organizations (art. 14).

Quota legislation

In addition to the principle of non-discrimination set out in the Constitution and the occupational health and safety rules set out in the Labour Code (arts. L180), Senegal has set a minimum access quota for persons with mental and physical disabilities in the civil service and in private companies.

Décret exécutif n° 14-214 du 30 juillet 2014 defines the terms and conditions for the reservation of working positions, the determination of the financial contribution and the granting of subsidies for the design and equipment of workstations for persons with disabilities.

Loi no 02-09 du 8 mai 2002 relative à la protection et à la promotion des personnes handicapées: The law guarantees the protection and promotion of persons with disabilities and regulates the provision of compulsory education and vocational training, social and professional integration, among others.

 

Ireland

RELEVANT LEGISLATION

Article 40(1) of the Irish Constitution states that all persons shall be held equal before the law. The Employment Equality Acts (EEA) 1998-2015 and the Equal Status Acts (ESA) 2000-2012 are the principal pieces of anti-discrimination law in Ireland. Both acts prohibit discrimination on the grounds of disability.

Quota legislation

Part 5 of the Disability Act 2005 covers the obligations on public service bodies to have 3% of people with disabilities amongst their employees. There is a government commitment to gradually increase this from 3% to 6%, and The Pathways to Work Strategy 2016-2020 indicates that the public service employment target for people with disabilities for 2016 was 4%.

The Act on Employment Promotion and Vocational Rehabilitation for the Disabled (Act No. 4219 of 1990) provides for the promotion of employment of physically or mentally disabled workers. Establishes for this purpose an Employment Promotion of the Handicapped Committee and an Employment Promotion Agency for the Handicapped.

Russia

Act No. 181-FZ of 24 November 1995 on Social Protection of the Disabled defines State policy in this field. The act provides for equality of opportunities of the invalids with other citizens in the realization of civil, economic, political and other rights and liberties provided for by the Constitution. And deals with medical and social expert evaluation, rehabilitation and social assistance.

The general Law on Equal Treatment in the Labour Market (LBK nr 1349 of 16 December 2008) forbids employers to discriminate on the basis of race, colour, religion or belief, political opinion, sexual orientation, age, disability or national, social or ethnic origin.

Finland

RELEVANT LEGISLATION

The Non-Discrimination Act (1325/2014) promotes equality and prevents discrimination as well as enhances the protection provided by law to those who have been discriminated against. People with disabilities are mentioned in section 15: ‘Reasonable accommodation to realize equality of persons with disabilities’.
